1. What these terms cover

These terms govern your use of the Yomble app and the service behind it (“Yomble”, “we”, “us”). By using Yomble you agree to them. If you do not agree, do not use the app.

2. What Yomble does

Yomble lets you leave a message at a geographic location. The recipient needs both the location and an access code, and has to be physically near the location to open it.

Messages are encrypted on your device before they are uploaded. The access code is the encryption key and never reaches our servers. We cannot read your messages, recover them, or tell you where they are.

3. No accounts, no names

Yomble deliberately works without user accounts. We ask for no name, no email address and no phone number, and we do not want them. German law expressly provides for the anonymous or pseudonymous use of online services, and this app is built around that.

What follows from it, plainly: we cannot tell you who left a message, we cannot restore anything for you, and we cannot hand over account data about anyone — none exists.

Misuse is dealt with in a different way: through reporting, blocking, and exclusion from the service. See sections 5 and 6.

4. Age

You must be at least 16 years old to use Yomble. If the law where you live sets a higher age for consenting to data processing, that age applies instead.

5. Free and Plus

Reading a message is always free — and always will be. Anyone who receives a link can open the message without paying anything and without installing anything beyond the app.

Free lets you leave as many text messages as you like, at any radius, for up to 30 days each, and share them by link or QR code.

Yomble Plus adds pictures, voice messages, videos, lifetimes of up to a year, a date from which a message may be opened, and placing a message at a spot you are not standing at. It is available as a yearly subscription or as a one-time purchase; both unlock exactly the same features.

“One-time” refers to the lifetime of the app in the App Store, not to yours. Should Yomble ever be discontinued, the purchase ends with it.

All prices include VAT. What applies is the price shown in the App Store at the moment of purchase; it varies by region and currency. Price changes to the subscription are handled by Apple, which informs you and asks for your agreement before renewing at a new price.

6. Purchases and subscriptions

If you lose access to Plus even though a purchase is valid, use “Restore purchases” in the app.

7. Right of withdrawal (EU consumers)

As a consumer in the EU you generally have 14 days to withdraw from a distance contract without giving reasons (§ 355 BGB). For digital content this right expires early once you have expressly agreed that performance begins before the period ends and have acknowledged that you thereby lose the right.

Apple manages this during the purchase, including the withdrawal information. For a refund, use reportaproblem.apple.com or contact Apple Support. Your statutory rights remain unaffected.

8. Zero tolerance for objectionable content and abusive users

There is no tolerance for objectionable content or abusive behaviour on Yomble. Reported content is reviewed, and accounts or devices found responsible are removed from the service without notice.

You must not use Yomble to create, send, or store:

You must also not place a message at a location you are not allowed to be, or in a way that endangers the recipient or anyone else.

9. Reporting and consequences

Every message you receive can be reported from inside the app. Because messages are encrypted, a report includes the decrypted text of that message — you are shown exactly what will be sent before you confirm.

Reports are reviewed by a person. We aim to act within 24 hours. Depending on what we find, we may remove the message, block the sender’s device identifier from the service, and where the law requires it, involve the authorities.

You can also block a sender at any time. Blocking works on your device and is not disclosed to the person blocked.

For anything that does not fit the in-app reporting flow — enquiries from authorities, general complaints — use the contact point named in the imprint. Note that a specific message cannot be reviewed by email: we cannot decrypt it, so the reporting function in the app is the only way to show us its contents.

10. What we do not promise

Yomble is provided as is. We do not promise that it will always be available, that messages will always arrive, or that location detection will work everywhere.

If you lose the access code, the message is gone. We do not have it and cannot reconstruct it. This is a consequence of the encryption, not an oversight.

Messages expire. The lifetime is chosen when the message is created and cannot be extended beyond the limits shown in the app. After expiry the message is deleted and cannot be restored.

11. Your content

What you write stays yours. You grant us only what is technically necessary to store and deliver the encrypted message — which, given that we cannot read it, is very little.

You are responsible for what you send and for having the right to send it.

The app, its name, its design and its code belong to the operator and are protected by copyright.

Map material comes from Apple Maps and remains the property of Apple and its data providers. Apple, iPhone, iPad, iCloud, Apple ID, App Store, Apple Maps and the Apple logo are trademarks of Apple Inc., registered in the US and other countries. Yomble is not affiliated with or endorsed by Apple Inc.

14. Third-party services and force majeure

Yomble depends on services outside our control — Apple’s app distribution, Apple Maps, the location services of your device, and our hosting provider. We are not liable for interruptions, delays or failures caused by outages, changes or discontinuation of those services, or by events beyond our reasonable control.

15. Liability

We are liable without limitation for damages caused intentionally or by gross negligence, and for injury to life, body or health. For slight negligence we are liable only for breach of an obligation essential to the purpose of the contract, and only up to the foreseeable damage typical for this kind of agreement. Liability under the German Product Liability Act remains unaffected.

16. Changes

We may change these terms. If a change is material — one that affects your rights or obligations — we will announce it at least 30 days before it takes effect, through a notice in the app, and the app will ask you to agree again before you continue. Corrections of typing errors and clarifications that do not change the meaning are made without notice.

If you do not agree, you can stop using the app before the change takes effect.

17. Applicable law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.

For consumers in the EU, the courts at their place of residence have jurisdiction. For all other disputes, the courts at the operator’s seat have jurisdiction.

18. Consumer dispute resolution

We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board (VSBG). The European Commission provides information on consumer rights and recognised bodies at consumer-redress.ec.europa.eu.

19. Severability

Should a provision of these terms be or become invalid, the remaining provisions stay in force. The invalid provision is replaced by a valid one that comes closest to its purpose.

1. Wofür diese Bedingungen gelten

Diese Bedingungen regeln die Nutzung der App Yomble und des dahinterstehenden Dienstes („Yomble“, „wir“). Mit der Nutzung stimmst du ihnen zu. Wenn du nicht zustimmst, nutze die App bitte nicht.

2. Was Yomble tut

Mit Yomble hinterlässt du eine Nachricht an einem geografischen Ort. Der Empfänger braucht sowohl den Ort als auch einen Zugangscode und muss sich physisch dorthin begeben, um sie zu öffnen.

Nachrichten werden auf deinem Gerät verschlüsselt, bevor sie hochgeladen werden. Der Zugangscode ist der Schlüssel und erreicht unsere Server nie. Wir können deine Nachrichten weder lesen noch wiederherstellen, und wir wissen nicht, wo sie liegen.

3. Keine Konten, keine Namen

Yomble arbeitet bewusst ohne Nutzerkonten. Wir fragen weder Namen noch E-Mail-Adressen oder Telefonnummern ab und wollen sie auch nicht haben. Das deutsche Recht sieht die anonyme oder pseudonyme Nutzung von Telemedien ausdrücklich vor; diese App ist darauf gebaut.

Was daraus folgt, ohne Umschweife: Wir können dir nicht sagen, wer eine Nachricht hinterlassen hat, wir können dir nichts wiederherstellen, und wir können über niemanden Bestandsdaten herausgeben — es gibt keine.

Missbrauch begegnen wir auf anderem Weg: über Melden, Sperren und den Ausschluss von der Nutzung. Siehe Abschnitte 5 und 6.

4. Alter

Die Nutzung von Yomble setzt ein Mindestalter von 16 Jahren voraus. Sieht das Recht an deinem Wohnort ein höheres Alter für die Einwilligung in die Datenverarbeitung vor, gilt dieses.

5. Kostenlos und Plus

Das Lesen einer Nachricht ist immer kostenlos — und bleibt es. Wer einen Link bekommt, kann die Nachricht öffnen, ohne etwas zu bezahlen.

Kostenlos kannst du beliebig viele Textnachrichten ablegen, in jedem Radius, jeweils bis zu 30 Tage lang, und sie per Link oder QR-Code weitergeben.

Yomble Plus ergänzt Bilder, Sprachnachrichten, Videos, Laufzeiten bis zu einem Jahr, einen Zeitpunkt, ab dem sich eine Nachricht öffnen lässt, und das Ablegen an einer Stelle, an der du gerade nicht stehst. Es ist als Jahresabonnement oder als Einmalkauf erhältlich; beide schalten genau denselben Umfang frei.

„Einmalig“ bezieht sich auf die Lebensdauer der App im App Store, nicht auf deine. Sollte Yomble eingestellt werden, endet der Kauf mit ihr.

Alle Preise verstehen sich inklusive Mehrwertsteuer. Es gilt der im App Store zum Zeitpunkt des Kaufs angezeigte Preis; er unterscheidet sich je nach Region und Währung. Preisänderungen beim Abonnement wickelt Apple ab und holt vor einer Verlängerung zum neuen Preis deine Zustimmung ein.

6. Käufe und Abonnements

Solltest du keinen Zugriff auf Plus haben, obwohl ein Kauf besteht, nutze „Käufe wiederherstellen“ in der App.

7. Widerrufsrecht (EU-Verbraucher)

Als Verbraucher in der EU hast du grundsätzlich 14 Tage, um ohne Angabe von Gründen von einem Fernabsatzvertrag zurückzutreten (§ 355 BGB). Bei digitalen Inhalten erlischt dieses Recht vorzeitig, sobald du ausdrücklich zugestimmt hast, dass die Ausführung vor Ablauf der Frist beginnt, und bestätigt hast, dass du dadurch das Widerrufsrecht verlierst.

Apple wickelt das während des Kaufs ab, einschließlich der Widerrufsbelehrung. Für eine Rückerstattung nutze reportaproblem.apple.com oder wende dich an den Apple-Support. Deine gesetzlichen Rechte bleiben unberührt.

8. Keine Toleranz für anstößige Inhalte und missbräuchliches Verhalten

Für anstößige Inhalte und missbräuchliches Verhalten gibt es bei Yomble keine Toleranz. Gemeldete Inhalte werden geprüft; wer dafür verantwortlich ist, wird ohne Vorankündigung von der Nutzung ausgeschlossen.

Du darfst Yomble nicht nutzen, um Folgendes zu erstellen, zu versenden oder zu speichern:

Du darfst außerdem keine Nachricht an einem Ort ablegen, den du nicht betreten darfst, oder auf eine Weise, die den Empfänger oder Dritte gefährdet.

9. Melden und Folgen

Jede empfangene Nachricht lässt sich in der App melden. Weil Nachrichten verschlüsselt sind, enthält eine Meldung den entschlüsselten Text dieser Nachricht — was übertragen wird, siehst du vollständig, bevor du bestätigst.

Meldungen werden von einem Menschen geprüft. Wir bemühen uns um eine Bearbeitung innerhalb von 24 Stunden. Je nach Befund löschen wir die Nachricht, sperren die Gerätekennung des Absenders und schalten, wo das Gesetz es verlangt, die Behörden ein.

Du kannst einen Absender außerdem jederzeit selbst sperren. Die Sperre wirkt auf deinem Gerät; der Gesperrte erfährt nichts davon.

Für alles, was nicht über die Meldefunktion läuft — behördliche Anfragen, allgemeine Beschwerden —, gibt es die im Impressum genannte Kontaktstelle. Eine einzelne Nachricht lässt sich per E-Mail allerdings nicht prüfen: Wir können sie nicht entschlüsseln, und nur die Meldefunktion in der App übermittelt uns ihren Inhalt.

10. Was wir nicht zusichern

Yomble wird ohne Zusicherung bestimmter Eigenschaften bereitgestellt. Wir sichern weder ständige Verfügbarkeit noch zu, dass Nachrichten immer ankommen oder die Standortbestimmung überall funktioniert.

Geht der Zugangscode verloren, ist die Nachricht verloren. Wir haben ihn nicht und können ihn nicht rekonstruieren. Das ist Folge der Verschlüsselung, kein Versehen.

Nachrichten laufen ab. Die Laufzeit wird beim Erstellen gewählt und lässt sich nicht über die in der App genannten Grenzen hinaus verlängern. Nach Ablauf wird die Nachricht gelöscht und kann nicht wiederhergestellt werden.

11. Deine Inhalte

Was du schreibst, bleibt deins. Du räumst uns nur ein, was technisch nötig ist, um die verschlüsselte Nachricht zu speichern und auszuliefern — angesichts dessen, dass wir sie nicht lesen können, ist das sehr wenig.

Für das, was du versendest, und für die Berechtigung dazu bist du verantwortlich.

13. Geistiges Eigentum

Die App, ihr Name, ihre Gestaltung und ihr Quelltext gehören dem Betreiber und sind urheberrechtlich geschützt.

Das Kartenmaterial stammt von Apple Karten und bleibt Eigentum von Apple und dessen Datenlieferanten. Apple, iPhone, iPad, iCloud, Apple-ID, App Store, Apple Karten und das Apple-Logo sind Marken der Apple Inc., eingetragen in den USA und anderen Ländern. Yomble ist nicht mit Apple Inc. verbunden und wird von Apple Inc. nicht unterstützt.

14. Drittanbieterdienste und höhere Gewalt

Yomble ist auf Dienste angewiesen, die außerhalb unserer Kontrolle liegen — Apples Vertrieb, Apple Karten, die Ortungsdienste deines Geräts und unseren Hoster. Für Unterbrechungen, Verzögerungen oder Ausfälle, die durch Störungen, Änderungen oder die Einstellung dieser Dienste verursacht werden, oder durch Ereignisse außerhalb unserer zumutbaren Kontrolle, haften wir nicht.

15. Haftung

Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung einer für die Erreichung des Vertragszwecks wesentlichen Pflicht und nur bis zur Höhe des vertragstypischen, vorhersehbaren Schadens. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.

16. Änderungen

Wir können diese Bedingungen ändern. Bei wesentlichen Änderungen — solchen, die deine Rechte oder Pflichten betreffen — kündigen wir das mindestens 30 Tage vor Inkrafttreten durch einen Hinweis in der App an, und die App bittet vor der weiteren Nutzung erneut um Zustimmung. Tippfehlerkorrekturen und Klarstellungen ohne inhaltliche Änderung nehmen wir ohne Ankündigung vor.

Bist du nicht einverstanden, kannst du die Nutzung vor Inkrafttreten der Änderung beenden.

17. Anwendbares Recht und Gerichtsstand

Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Bist du Verbraucher, bleibt der Schutz zwingender Vorschriften des Rechts deines Wohnsitzstaates unberührt.

Für Verbraucher innerhalb der EU sind die Gerichte an ihrem Wohnsitz zuständig. Für alle übrigen Streitigkeiten sind die Gerichte am Sitz des Betreibers zuständig.

18. Verbraucherstreitbeilegung

Wir sind weder bereit noch verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen (VSBG). Die Europäische Kommission stellt Informationen zu Verbraucherrechten und anerkannten Stellen bereit unter consumer-redress.ec.europa.eu.

19. Salvatorische Klausel

Sollte eine Bestimmung dieser Bedingungen unwirksam sein oder werden, bleiben die übrigen wirksam. Die unwirksame Bestimmung wird durch eine wirksame ersetzt, die ihrem Zweck am nächsten kommt.
